These Terms and Conditions govern your use of the Santither Bakes website at santither.com and any purchase of products or services from Little Cupcakes, trading as Santither Bakes. By accessing our website or placing an order with us, you agree to be bound by these terms in full. If you do not agree with any part of these terms, you should not use our website or purchase our products. We reserve the right to update or modify these terms at any time, and the most current version will always be available on this page with a revised effective date.
By browsing our website, submitting an enquiry, placing an order or otherwise engaging with our services, you confirm that you have read, understood and accepted these Terms and Conditions. If you are placing an order on behalf of a business or organisation, you represent that you have the authority to bind that entity to these terms. These terms apply to all users of the website, including without limitation browsers, customers, vendors and content contributors.
All orders placed through our website or via email, phone or in-person communication are subject to availability and confirmation by our team. When you place an order, you are making an offer to purchase the specified products. We reserve the right to accept or decline any order at our discretion. An order is confirmed only when we send you a written confirmation via email.
Prices listed on our website are in Australian Dollars and are inclusive of GST unless otherwise stated. We make every effort to ensure pricing accuracy, but errors may occasionally occur. If we discover a pricing error after you have placed an order, we will notify you and give you the option to proceed at the correct price or cancel the order for a full refund.
Payment must be received in full before your order is prepared, unless alternative payment arrangements have been agreed upon in writing for corporate or event orders. We accept payment via major credit and debit cards through our secure third-party payment gateway. All transactions are encrypted using industry-standard SSL/TLS technology to protect your financial information.
For custom celebration cakes and large catering orders, we may require a non-refundable deposit of up to 50 per cent of the total order value at the time of booking, with the remaining balance due at least 48 hours before the scheduled delivery or collection date.
We offer delivery throughout metropolitan Melbourne seven days a week. Delivery fees are calculated based on your delivery postcode and are displayed during the ordering process. For orders exceeding $120 in value, delivery within a 20-kilometre radius of our Southbank kitchen is provided at no additional charge.
Delivery time windows are provided as estimates and are not guaranteed. While we make every effort to deliver your order within the specified time frame, delays may occur due to traffic, weather conditions or other circumstances beyond our control. Santither Bakes shall not be held liable for any loss or inconvenience caused by delivery delays. It is your responsibility to ensure that someone is available at the delivery address to receive the order at the estimated time. If delivery cannot be completed due to an incorrect address or the absence of a recipient, additional delivery charges may apply for redelivery.
All baked goods are packaged with care using food-safe materials designed to maintain product quality during transit. However, due to the delicate nature of our products, minor cosmetic variations may occur during delivery and do not constitute grounds for a refund or replacement.
You may cancel or modify your order free of charge up to 48 hours before the scheduled delivery or collection date by contacting us via phone or email. Cancellations or changes made within 48 hours of the delivery date are subject to a cancellation fee of up to 50 per cent of the total order value, as ingredients may have already been purchased and preparation may have commenced.
For custom celebration cakes and wedding cakes, cancellations made within seven days of the delivery date will forfeit the full deposit. We understand that circumstances can change unexpectedly, and we will always work with you to find a reasonable solution wherever possible.
All content on this website, including but not limited to text, images, photographs, graphics, logos, icons, designs, page layouts and software, is the property of Little Cupcakes trading as Santither Bakes or its content suppliers and is protected by Australian and international copyright, trademark and intellectual property laws. You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store or transmit any material from our website without our prior written consent, except for your own personal, non-commercial use such as viewing or printing individual pages for reference.
The Santither Bakes name, logo and associated branding elements are trademarks of Little Cupcakes. Use of these trademarks without our express written permission is strictly prohibited and may constitute a violation of trademark law.
To the fullest extent permitted by law, Santither Bakes, its directors, employees, agents and affiliates shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, data or goodwill, arising out of or in connection with your use of our website or the purchase of our products, regardless of the cause of action or the theory of liability.
Our total liability to you for any claim arising out of or relating to these terms or our products shall not exceed the total amount you paid for the specific order giving rise to the claim. Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under Australian Consumer Law.
We take food safety extremely seriously and comply with all applicable food safety regulations and standards in Victoria. However, it is your responsibility to inform us of any allergies, intolerances or dietary requirements when placing your order. While we take every reasonable precaution to prevent cross-contamination, our kitchen handles common allergens including wheat, dairy, eggs, nuts, soy and gluten, and we cannot guarantee a completely allergen-free environment.
These Terms and Conditions are governed by and construed in accordance with the laws of the State of Victoria, Australia. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Victoria. If any provision of these terms is found to be invalid, illegal or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. Our failure to enforce any right or provision of these terms shall not constitute a waiver of that right or provision.
